Hypothetical or simulated performance results have many inherent limitations. No representation is being made that any account, trader, software, or indicator will or is likely to achieve profits or losses similar to those shown.

You acknowledge and agree that:

  • Hypothetical performance does not represent actual trading results.

  • Hypothetical results are prepared with the advantage of hindsight.

  • Real trading involves real risk, slippage, latency, and emotional factors that hypothetical data cannot simulate.

  • Past performance of indicators or methodologies is not indicative of future results.

Only risk capital—money that can be lost without impacting your lifestyle or financial security—should be used for trading.

By accessing or purchasing from this website, you agree to the following conditions:

3.1 No Financial Advice

Smart Indicator Solutions provides software tools and indicators. These are not financial advice and must not be used as such.

3.2 User Responsibility

You are fully responsible for your trading decisions and outcomes.

3.3 Eligibility

You must be at least 18 years old to use or purchase our products.

3.4 Intellectual Property

All software, indicators, code, documentation, logos, and branding are protected.
You may not redistribute, resell, reverse-engineer, share, decompile, or otherwise make any part of the software available to third parties.

3.5 Availability & Updates

The provider may update, modify, or discontinue features or the software at any time.

3.6 Technical Requirements

Your trading platform (e.g., NinjaTrader) must meet the technical requirements. We do not guarantee compatibility with modified or outdated systems.

4. Refund Policy (EU-Compliant • 14-Day Free Trial Instead of Withdrawal Right)

4.1 Free Trial (14 Days)

Before purchasing, every customer can use the software free of charge for 14 days.
This allows full testing of features, compatibility, and performance.

4.2 No Right of Withdrawal After Activation

Under EU law, digital content that is:

  • not supplied on a physical medium, and

  • is delivered immediately after purchase

can be excluded from the right of withdrawal only if the customer agrees to immediate delivery.

By purchasing our software, you expressly agree that:

  • the software license is activated immediately,

  • the 14-day trial has already allowed you to test the product,

  • your right of withdrawal expires upon delivery of the digital content.

Because you had the opportunity to fully evaluate the software before purchasing, no refunds can be issued after the license is activated.

4.3 Technical Issues

If any technical problems occur, we will provide full support to fix them. Lack of performance in trading markets is not a valid refund reason, as trading involves risk and depends on market conditions.

5. Software License Agreement

5.1 Grant of License

Upon purchase, Smart Indicator Solutions grants you a non-exclusive, non-transferable, revocable license to use the indicator on your personal NinjaTrader account.

5.2 Restrictions

You may not:

  • Share the software with third parties

  • Resell, rent, or lease the software

  • Modify, decompile, or reverse-engineer the code

  • Upload or distribute the software publicly

Violations may lead to immediate license termination.

5.3 Ownership

All rights remain with Smart Indicator Solutions. You receive only a license to use the software—not ownership of the code.

5.4 Updates

Updates may be provided at our discretion. Your license does not guarantee new features.

5.5 Termination

The license may be revoked if:

  • You violate the Terms of Use, or

  • You redistribute or misuse the software.

6. Limitation of Liability

Smart Indicator Solutions is not liable for:

  • Trading losses

  • Platform failures

  • Market movements

  • Data delays

  • System outages

  • Damages arising from the use of our software or website

To the fullest extent permitted by law, our liability is limited to the purchase price of the software.

7. Privacy Policy (Short Summary)

  • We collect only the data necessary to process purchases and provide licenses.

  • Your data is stored securely and never sold.

  • Personal information is processed in accordance with the EU GDPR.

8. Jurisdiction

These terms are governed by the laws of Austria.
Any disputes shall be resolved in Austrian courts.
